I'm still waiting to hear back from the Antitrust Division to tell me what is specifically illegal with regards to competitors discussing prices. If I have no luck there, I'll check with an antitrust lawyer :) Either way I will post whatever advice I get from a *qualified* legal representative. We all have opinions on this, but unless we're lawyers or part of the DOJ Antitrust Division, we cannot necessarily be considered qualified sources. While we can provide our own interpretations of the laws, those interpretations should NOT be considered the letter of the law. Consult a lawyer if that is what you're looking for.
In response to the "freedom of speech" issue brought up - freedom of speech doesn't necessarily cover discussions that are outlined as illegal in the US. You can express yourself to your heart's content, but if you're publicly discussing something that is illegal, that could be used as evidence of your intent to commit a crime.
I do realize that this list is not based in the US, but many of its subscribers are. Those subscribers are bound by the laws of the US, regardless of where their discussion takes place.
Once again, I am not a laywer, and I am not providing legal counsel. I am stating my own opinions, which do not necessarily represent the opinions of the US Department of Justice, the US Trustee Program, or any other entitity.
Finally, some food for thought... While those of us who DO choose to post rates may not intentionally be influencing the rates of others, they may in fact be doing just that. What happens when more and more of us base our rates on what is considered "the norm" for Flash development?
